  • Consent is based on CHOICE.

  • Consent is active not passive.

  • Consent is possible only when there is equal power.

  • If you cannot say “no” safely and comfortably, then “yes” has no meaning.

  • Going along with some activity in order to feel accepted. is not consent; cooperation does not equal consent.

  • Going along because of deceit is not consent.

  • Giving in because of fear or pressure is not consent.

  • If you are unwilling to accept “no”, then “yes” has no meaning.

  • Needs to be informed consent: both parties must know and understand the action proposed, and must be able -- physically, emotionally, legally -- to agree to participate.

 

Montana law says it's not consent if:

  • A person is under 16 years of age;

  • A person is –

    • drunk or drugged;

    • deceived, coerced or surprised (as in either acquaintance or stranger assault); or

    • mentally ill
